My PD is Feb 2007, EB3 category.
My I-140 is approved and I485 was filed in July 2007 (pending more than 180 days)
I have an EAD.
My employer revokes the I-140 for people they lay off. Does the RFE come immediately when they revoke the I-140 or does it come at the time of adjudication - which in my case is a long time away since my PD is Feb 2007 in EB3 category.
Per past trend, USCIS sends RFE, NOID, Denial notice within few weeks of processing I-140 revocation. There is no definitive timeline, it could come anytime.

What was the original I-140 revoked for ?
If it is not revoked for fraud or misrepresentation, you can port.

Hi All,
I would like to know if i can file multiple 485s being primary on both ?
Here is my current status ...
1. Company A sponsored my GC and the priority is Oct'03 (never worked for this company)
2. Company B sponsored GC (priority Nov'05). - Currently working for this company
3. Both are EB-3
4. Applied 140 & 485 thru concurrent processing (Company A) in 2004
5. Now that all the dates are current, I am eligible to file 485 (Company B)
So my question is can i have two 485s filed ?
First case is future employment case but has '03 priority
Second case is more strong, but with '05 priority.
I am confused, what to do now.
Any advice is appreciated.

In most of the job boards, we see the following employment types:
1. Full Time (this I understand :))
2. Contract - Corp 2 Corp ---> Headhunters
3. Contract - Independent ---> Citizens
4. Contract - W2 ---> EAD/GC
5. Contract to Hire - Corp 2 Corp/W2/Independent ---> Likewise as above, only on contract 1st

Hi,
My 485 status on USCIS site is showing Document production or Oath Ceremony. The status changed on 7/8/2010. What does this status mean. Does this mean approval? How long does it take to recieve the actual card once the case enters to this state.

I am not sure what is the process after fingerprinting. Can someone please clarify?
I believe NameCheck must have been initiated. As far as processing 485 is concerned, does the PD have to be current?

Political scene and policy making is mostly based on vote and voice more then TRUE reform. Always, be it India or USA.
Immigration-Voice is primarily for legal immigrants. Even though we input substantial economic value to the society, and to the fate of all of us the small legal/skilled people immigration reform is tied to the big CIR.
What I want to propose is to talking to other lobbing groups and immigrant associations.
Irish, Spanish etc... Today in the news the Irish Lobby for Immigration Reform (ILIR) made a big show and seems like they have got lot attention. Form senator Clinton to one time Irish Kennedy all spoke for Irish and CIR.
Also, Immigration voice is primarily supported by Indians and few other people from other nationalities.
In addition, I being an Indian like to propose bringing more attention and contributions to the situation by talking to local and north American Indian associations both professional and cultural.

American Telugu Association

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

Myself(Husband) & mywife both came on H1B from same employer.
My son got H4 visa through my wife H1B visa.
I (Husband) applied for green card and got EAD for myself & mywife , got Advance parole for myself, mywife & myson and are in 485 pending AOS status,
My Wife is taking permanent job with EAD (EAD is through my Greencard process)
If employer cancels my wife H1B she will come to EAD status.
I am not sure what will be the status of my son who is currently on H4 visa through my wife H1B visa.
My son got Advance Parole and 485 pending status through my green card.
Do I need to apply for H4 visa for my son or will my son be ok on pending AOS status ?
His status is AOS. Unless a decision is made on your GC he needs no other visa or documentation to be in USA. If your GC application gets denied (Should not happen ever) then you lose AOS and you will have to talk to an attorney to see how long you can be in US - for the sake of filing an MTR etc.
Once a person files for 485 and application is pending a decision they can be in US without a VISA. If you travel outta US and needs re-entry that could be done useing AP. Hope this helps........

After 12 months of toil I have finally completed the narrative and evidence that I need for an EB-1a (Extraordinary Alien) application. I ab about to complete the I-140 paperwork to go with it.
My questions is this - I have contacted a small number of Immigration attorneys who have quoted me approx $6000 for the whole process. How many of you value think that USCIS would look at my application more favourably if I used a reputed attorney rathen than putting in my own application and paperwork ?

USCIS will be interested in the content of the application rather than the reputation of the attorney submitting it. You are free to submit your own application if you are comfortable researching immigration laws required for your application.

I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.

There was a report on Mathew Oh's site that
some people travelled in 2008 got a messed up I-94
forms( printing bug). So whoever travelled in 2008
may want to have a very good look at their I-94 and
correct it if needed.

AILA has reported that sometime early 2008, U.S. Customs and Border Protection received approximately one million I-94 Arrival-Departure cards that were misprinted. Correct and valid I-94 should have 11 digits of I-94 numbers. If your I-94 shows only 9 didits or 10 digits or less than 11 digits, your I-94 card is one of these million's defective cards. The agency is recalling such defective I-94 cards for replacement I-94. Reportedly these defective I-94 cards were issued at the Calgary Airport in Canada and potentially other airports as well. Those who have such defective I-94 should contact Deferred Inspection posts or any Port of Entry for issuance of replacement I-94. Defective I-94 can create a number of problems down the road unless they obtain replacement I-94.
