Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )
Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

I don't know of any way to detect I-140 revocation. Contacting the employer's legal department is the only solution ...

Just announced today is the new fujifilm S3 with its proported 12 MP sensor! It will consist of 2 "stacked" 6 MP sensors one for normal detail, one for highlights supposedly giving 4 times the dynamic range. The file output will remain 12 MP as was with the S2.

In my opionin, it still does not sound like a real 12 MP, rather an enhanced 6 MP cause all they have done is extended DR by adding a second pixel at each photosite. Now lets see how DR is actaully affected, claims of 4x DR are pretty large and tough to live up too! If the previous camera had 4 stops of DR that would mean 16 stops now? Nothing I've seen ever had that wide a range!

Hi Everyone,
I am on H1B with Labor approved about 2.8 years ago and I-140 approved for over a year ago.
I am July2007 fiasco filer of Indian origin.....in US for a some 13 years and I am Canadian citizen.
I have almost 2.5 years of H1B still left from my 3 year H1B extension.
I had EAD before but never used it, so my employer has not renewed it.
I am currently working on H1B.
I understand I am not allowed to work in my own business while on H1B, but I can have profit or loss from it......so it doesn't make sense to start a consulting business while on H1B in my opinion (correct me if I m wrong btw).
Starting a Consulting Business on EAD:
Now I want to start a consulting business in the same/similar field of my current job for which my greencard was applied and is still pending.
Please help me with the following:
Q1: Can I start the this consulting business while on EAD? Is LLC the best option?
Q2: Will it be then job portability from my current job to this new job in my company using AC21?
Q3: What conditions do I need to fulfill for working in my own company to keep my greencard alive?
Q4: What evidence do I need to keep handy to show USCIS if asked?
Q5: Am I supposed to inform USCIS when I do this job chnage?
Q6: Are there any minimum revenue requirements or do I have to pay myself same or more salary than my current job?
Q7: What if my business does not take off quickly and I can not pay myself same salary like my current job?
Q8: Can I apply EAD myself or I need my current employer to do so? I have the old expired EAD card that I never used.
Q9: I also don't have my job description from my labor certification. Is there a way for me to get it directly from USCIS?

Ah, that won't really be possible unfortunately by applying it directly to Frame. The Frame is basically a window through which you view the world (XAML pages loaded into it). It has no real control over what gets loaded - it is only a spectator.
What you can do is specify a transition effect on each XAML that plays when that page loads. The end result is that tour frame will display a transition effect, but that transition effect would have been entirely defined in the page that gets loaded instead of having it live on the single page containing the Frame.

Is there anyway we could include EB immigration relief in the Economic Stumilus Package announced by President Bush by bringing up creative pointers such as more greencards = more small businesses, more greencards = more home buyers, etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

A few months ago, BEC would respond to emails from the beneficiary regarding case status if the beneficiary mailed from the company email Id. They would send a screenshot of your case details. You will have to include your name, company name, state applied from, and DOB. I did that several months ago and got a reply from DBEC. I sent them an email with my details requesting them to send my case details so I could file for my 7th year H1 extension and got back a reply with screenshot after 2 or 3 days. You can give that a shot but no guarantees that BEC will respond as I heard they stopped doing that now. You can get the email Ids for 7th yr H1 ext email queries from the DOLs site. Good Luck.

Can we use an Existing Adv. parole Document that was stamped at the POE this year be used Again for Travel Purpose. It has a Valid date and expires in September '08. I am planning to visit europe next week and i couldn't find the 2nd AP Document that was never used.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. A group of volunteers from OneAmerica (a local pro-immigrant non-profit associated with the Reform Immigration for America Campaign) and I visited the offices of Senators Murray and Cantwell (both D-WA) in the last week. We met with their outreach directors for our county and presented them with almost 1000 signatures of Microsoft employees impacted by retrogression. We also gave them a presentation similar to the one IV gave back in 2006-2007.
They were frank with us, both senators are our allies but they are not sure if they will tackle immigration, financial reform or energy/climate change reform before the Nov. elections. However, they said they will try to keep us in the loop and give our docs to the senators. We will not let up and will keep pinging them for action.
They thanked us for showing up and providing some great personal stories to back up our petitions. They also asked us to keep in touch in case they need compelling stories to help promote all aspects of CIR.
Let's keep visiting lawmakers and help them commit to CIR this year!

no labor is position dependent not person dependent. You cannot make it go faster based on earlier 140.

If your company is regularly advertising and they have all the ad's in place as required by PERM , they can file your PERM and you can get your labor approval. If in case your labor is approved before 30th july you would be able to file concurrent 140 & 485 and can retain your PD too.
