You don't have a choice here unless either you or your spouse hold a non-indian citizenship, either by birth or naturalization.
IMHO, don't bother with either. Just get a US passport for our son and get a 10 year visitor visa to India.

According to TRAC (http://trac.syr.edu/immigration/reports/240/), Justice Department data show that Immigration Judges are declining substantially fewer requests for asylum. Denial rates have reached the lowest level in the last quarter of a century.
Twenty five years ago, in FY 1986, almost nine out of ten (89%) of the asylum requests in the Immigration Courts were denied. While the annual rates have gone up and down during the ensuing years, only half (50%) of the requests were denied during the first nine months of FY 2010 � a record low.
One factor contributing to the improved success of the asylum seekers is that a higher proportion of the total are represented by counsel. It must be noted, however, that the number of those seeking asylum in court proceedings has fallen.

I concurrently filed both my I-140 and I-485 back in Oct 09. My I-140 was approved on March 18th and then nothing since. I read that by concurrent filing the process is quicker. I am on an EB1-C. My question is has anyone had any experience in the time frame for concurrent filing under the category i am under? I have checked the tracker and cannot see anyone in similar position. Time line is what i am looking for or is it a "wait and see" situation?

Hello,
I have been approved for a new H1 visa for 2 years - Consulate Case. My previous visa extension was denied & so applied for a new one with a different company in a different state. I m trying to book an appointment online for the interview in which I have to fill up DS 156 form. There is one question # 24, where it is asking me write the address where I will stay. At present, I have not decided on address as I don't know stamping would be approved or not. So what do I need to write there. I presently stay in a different stay where I own a house.
Lawyers & experienced people pls. help out as soon as possible... I am running out of time...

I am currently on EAD working to company B after invoking AC21 for past 1 year. Thinking of starting GC processing with current company.
So I asked my old company A to give me a copy of my approved I-140. He sent me a courtesy copy. Since i read in forums that copy of the original not courtesy is required, I sent a mail to Lawyer CC'ing my old company and I got a reply from the lawyer that he did not pay the lawyer fee. OfCourse like any desi company my old company collected lawyer fee from me. I am sure he will not pay it and already he stuck me in EB3 after promising EB2. SO I am pondering on my options.
Does any one know if I can use the courtesy copy of I-140 to proceed with my new GC process?
I read from one other forum I can use FOIA(Freedom of Information Act) and get a copy of I-140, but it will take minimum of 8 months.

1) Many of us have already used AC21, The current economic condition might force us to switch job on EAD, Can we file AC21 multiple times. Has any one done this.
2) If I do not file AC21, with new job and can we leave with the 1st employer as for future employment, Join the original employer we filed AC21 upon approval of GC, In than condition, an offer letter from the employer hold good in case of RFE.

You should have asked before filing for an extension or do a search at USCIS Home Page (http://www.uscis.gov) you would have come across the below:

They are not always up to date on their processing times.
Evidently.... I guess I can't rely on it too much for predicting approval of the other applications. I heard of a similar situation too, the receipt date is very close to mine and it got approved today.

BTW, the easiest way to get back to H4 status is by reentering the country using H4 visa. For which, you will have to maintain H1 status, if you want her to have H4 status in the future.
I think she/he can change status from EAD to H4 without reentering the country...There is something like change of status ....I am not sure about it...Experts can comments further...

Yes, it can be done. Basically, you have to show that the work experience is at least the equivalent of a College degree. There are people, called "evaluators" (or something like that) that analyse all the credentials and work experiences to determine that equivalence.
